    Default Can a man be charged of murder......

    ......without a body being found?

    I find it disconcerting that the name of an accused has been disclosed to the public, when nothing has been proven.

    There was a case abut a year or two ago, I think it was in Bristol, where a teacher was named as the chief suspect for the murder of a young lady. The young lady had a few drinks with her friends after work during the Christmas holiday period and had returned home with a pizza. It turned out that the accused teacher did not do it and that it was a guy who lived in the adjoining flat did.

    The teacher was vilified for all sorts of things in the press and even accused by his students as being a creep (perhaps made up stories), when the man was innocent of any wrong doing. His life was nearly ruined. What if it could not have been proved who the real murderer was? The poor man would have been destroyed.

    There is doubt.....and beyond a reasonable doubt....I guess, in the eyes of the law!!!!

    No they shouldnt be but there have been cases. I'm reading all the spitefull threads on Facebook and peoples outrage over nothing is sickening.

    no evidence or any information have been released, so far the man is innocent and at this point in time who are we to judge..

    and clear photos of him. yes, I agree, I can't see a public interest in disclosing that when there is only an initial arrest. If it turns out it wasn't him the suspicion will severely f£$k up much of his life.

    They must have some pretty compelling forensic evidence or they wouldn't have charged him.

    Assuming it goes to trial they'll need extremely compelling evidence to get a conviction

    Put it this way, it is possible to dispose of a body if you have the skill, time and patience to cut it into small enough pieces than can then be distributed/disposed of/burned.

    If you couldn't charge a person of murder without a body then that would effectively legalise murder for those with the skill/time/patience to dispose of the body in this way.

    Circumstantial evidence can be quite compelling that the absence of a body can become less necessary, although obviously would help by virtue of DNA evidence etc.

    On the matter of making name/face public- I think there needs to be some provision for protecting those wrongly accused. I'm just not quite sure how to do that in 2012.
    Even if you could stop newspapers, the internet is unstoppable.

    You have to be able to charge people with murder without a body.

    Think about the moors murders. They still don't have bodies for all of them, but you wouldn't want someone going free in a case like that.
