Could this be (on the buyers part not yours) a form of money laundering. They buy with dodgy money, don't collect goods, get 'clean' money refund from PayPal.
If he paid you PayPal, the money was likely clean. Money laundering is really cash laundering - although there is an aspect to it (called 'layering') which might be occurring. Whatever, you should ideally have acted on it way before a month was up. Not hectoring and I guess you know that now. Whatever always cover yourself by reporting such shenanigans to EBay. They are, it is true, biased in favour of the buyer (because they are seen as punters) but EBay have to observe the law, whereas punters can only be taken to court, if you get the distinction.

Apologies for going off piste, but if you're looking for a Fernandes, I have a Jazzmaster Sustainer for sale, bit special. Pm me if interested.

    +1.

The guy sounds like a right pain, but keeping the money is just stealing.

As I understand it the buyer bought an item that was listed for collection and not for postage so until he responds to the seller to arrange alternative methods the O.P can sit tight . The guitar should be put into storage but not sold .
I wouldnt offer a refund until some communication on the matter has been achieved .
Like the O.P said "the ball is in his court now" but another email to the buyer wouldnt go a miss .

Think I'd send one more reminder to the buyer then do nothing, put the guitar to one side and 'sit' on the money - but don't spend it obviously. I had a similar, but reverse experience.

I bought a photo (Valentino Rossi) off a woman for £1.70, sent cheque straight away then - nothing. Sent a few 'Hi, did you receive the cheque ?' pms, still no reply. Then got a 'non-payment case has been opened against you' message off Ebay. Horrified, I told Ebay the story, more 'did you?' pms to the seller, still nothing. Almost a year later: still no photo, no more messages, nothing, but no bad feedback either I have 350-odd '+' feedback. Coulda bin a strange wind-up time waster or just an idiot, there a few about....

Probably couldn't be bothered cashing a cheque for such a small amount.

You can't keep the guitar and the money.

He has paid - the guitar actually is his. Technically speaking if you sold it he could sue for Conversion or Bailment.

I'd give him 14 days notice, then refund the money in the same way you got paid and then do what you like with the guitar. If you have a postal address - send him the notice by recorded delivery.
Sibella: He says he wants to go to Europe to expand his mind.Louis: He certainly has room to do so.

    and this.

No way you can keep the money. Also you've paid a seller's fee on the item. You or he needs to open a case and just refund and you'll get your seller's fee back if it's not too late. However, as the man says, you can just hold on to it until such point as he picks it up. Then you can keep the money but don't sell the guitar again or you're basically stealing. Just tell the buyer what you're doing and leave it at that. if he tried to open a case saying "item not received" you could just point out that he hasn't paid postage, nothing to fear.

I bought something last year which i still haven't picked up, but i'm in touch with the seller and i've paid for it and when i finally get over that part of the country i'll go and get it.

Yeah, I'd agree with this. As much as I'm annoyed with the transaction, and feel that the buyer doesn't deserve any courtesy from me, I couldn't bring myself to sell the guitar again - it just wouldn't be kosher and would bug me.

I'm quite happy to hold on to the guitar and will act according to his communication. However, I'm not keen on the idea of me having to do all the legwork; I spent enough time arseing around trying to get him to answer messages, pay, pay postage, etc. All he has do is pay £20, and I've also suggested a refund to which he hasn't responded to. Over to him really.

Thanks for all the replies on the matter, much appreciated.
